Develop and approve an instruction or regulation for the internal alert system

Obligation provided for in articles 5 and 9 of Law 2/2023, of February 20, regulating the protection of people who report regulatory and anti-corruption violations.

A prior consultation must be carried out with the legal representation of the workers, so that, if applicable, they can express their opinion on the creation of the SIA and make observations. Their observations are not binding.

  • Prior consultation has been carried out, informing the workers' representation of the creation of the SIA and a period has been provided to submit observations.

City councils, dependent entities or autonomous bodies have the modeling of files for the approval of the standard instruction model or standard regulation model, on the operation of the internal alert system developed by the entities that make up the Open Government Network of Catalonia.

The approval of the instruction will be made by Mayoral Decree, by Plenary Agreement or by the highest management bodies. The approval of the Regulation will follow the corresponding procedure, and will be approved by Plenary Agreement or by the highest management bodies.

A)   MODEL TYPE OF INTERNAL ALERTS SYSTEM OPERATING INSTRUCTIONS .

  • The file has been prepared to approve by decree/agreement the operating instructions for the internal alert system and once approved

  • The decree/agreement has been published on the transparency portal of this organization.

B) MODEL TYPE OF OPERATING REGULATIONS OF THE INTERNAL ALERTS SYSTEM.

  • The file has been prepared to approve by agreement the Regulations for the operation of the internal alert system. And once approved

  • The final approval agreement is published, along with the full text of the Regulation, in the Official Gazette of the province, in the municipal electronic headquarters and in the local newsletter (If you do not have a local newsletter, you should ignore this reference).

  • Published in the DOGC the reference of the BOP in which the full text is published, and on the transparency portal the full text of the Regulation.

  • The final approval agreement and the complete and reliable copy of the final approved text have been sent to the State Administration and the Generalitat of Catalonia within 15 days from the date of the agreement.

Request the alert channel

You can request registration for the AOC service in parallel with the approval of the SIA operating instructions or regulations and the designation of the person or persons responsible for the system.

To request service registration, you need to know who the person designated as EACAT service manager is.

The procedure is to request registration and modification of AOC services , you must fill out the application and in the drop-down, mark the option “Alert Channel”.

In this form you are asked to designate a person responsible for the service who is the technical contact and has the ROLE of ADMINISTRATOR . This person may or may not be the person responsible for the SIA.

The initial access and management of the internal alert channel, communication with the AOC and management of possible subsequent incidents will be the responsibility of the administrator who may fall into a technical, IT, legal or administrative profile of the local corporation or a technician of the Regional Council, in case they can provide this assistance. The administrator:

  • receive the registration email from the test environment and the real environment,

  • create the form or adapt it based on your organization, as well as create different contexts and manage the environment,

  • does not see the cases but does access the register of communications submitted

  • can register other administrators,

  • register the recipients (managing body and/or person/s responsible for the internal system).

First, you receive an invitation to access the common testing environment (shared piloting entity) and within a period of seven days, you receive registration for your own environment (your own individual entity).
